Boundary Adjustment
An informal agreement had been in place for several decades between two Hamilton properties down a shared right of way, where the front lot would drive through the neighbouring lot to avoid removing a mature stand of native trees. Recognising that this scenario could be revoked if the ownership of the servient* property changed, the owners of these two properties agreed to legalise the access.
The BCD surveying team worked with the clients and prepared new scheme plans with minor boundary adjustment and new easements, while the planning team managed the process with local council.
*Servient property is a parcel of land that is subject to an easement and benefits another parcel of land, i.e. the property at the end of the shared right of way.
